The point is, you will find it is purposely vague if not downright absent on the subject of what to do with people who engage in military action that is NOT between two declared states... You ask: "How do you think our men and women in the military were treated when they were captured by the likes of Al Zarqawi"....how about the indiscretion used when utilizing force...whether it be bombs of such magnitude dropped from thousands of feet in the air, or whether it's ground troops firings rounds indiscriminately on the ground. Do you realize just how grotesque and lopsided the ratio of civilian/non-combatant deaths is to the number of soldiers that perish?

The true victims of terrorism are innocent people who lose their lives...whether it be in America, in Iraq, in Afghanistan, etc. Terrorism has a broad definition...many people fail to apply the label of 'terrorism' to those that brandish proper uniforms and who command high-tech weapons to kill the enemy.

That statement is reminiscent of the comments made by the likes of John Kerry and John Murtha, both former military and both democrats who were quick to demonize and demoralize our troops with comments like yours. And for you to liken our military in uniform to the terrorists is outright dispicable. Why do you have such disdain for the men and women of the military that serve to protect you and America? Do you realize that war is grotesque period but sometimes necessary and civilian lives will be lost regardless of the discretion used?

Do you realize just how many prisoners are kept in Guantanomo Bay without any proper charges against them? The overwhelming majority of prisoners in G.B. are there simply because of the names they were born with; coupled with suspicion placed on them....suspicion/one's name doesn't automatically translate to guilt.

Let's see if I can help out here. As jdoc said, the Geneva Conventions were held to define legal warfare. Anyone who falls under the definition of unlawful combatant does not have Geneva Conventions rights. If they did, then every combatant would be legal. See article 4, section 2:

The Obama justice department released their ruling on Feb. 19th stating that the 600+ prisoners at Bagram Air Base in Afghanistan have no right to challenge their detention in U.S. courts, just as the Bush administration had contended. All of the Gitmo detainees will simply be moved to that facility. Since they insist on closing Gitmo in an effort to have the world approve of us they'll have no choice. They will continue to be interrogated, and eventually most will probably be executed, as they deserve. Whether they are terrorists or just happened to be taking a Sunday stroll through a combat area, is not provable in any court, since they are unlawful combatants, and not in any uniform. At some point you have to put your trust in someone. I'll choose our military over our enemies, you can trust Al-Qaeda if you want. If even after several hearings and reviews, which every prisoner has had, we hold an innocent civilian, it is an unfortunate circumstance, but inevitable situation in every guerrilla war.
Furthermore, the Obama administration has chosen to continue the rendition program, first instituted by the Clinton administration. Boo hoo, we mistreat individuals who disregard every international law of conflict and fight for no state. They always afford our captured military with nothing but respect, right?
Now then, as far as Obama, NObama is concerned. We've seen every promise with regard to his cabinet appointments be disregarded. He insisted the surge in Iraq would fail, and now is taking advantage of it's success to remove most of our troops, but only a draw-down to 35,000-50,000. He implements a surge in Afghanistan, for which he's had to answer no questions regarding success or exit strategy. He's closing Gitmo, but the detainees will never see a U.S. court. He's insisted on fiscal responsibility while presiding over more deficit spending instituted and proposed through the first 30 days in office than the entire 8 years of the Bush administration. He says we need to create jobs, and sets into place policies that do nothing but punish business. He says we must live within our means, but want's to force banks we now own to continue to give loans to people who can't afford them. He does nothing but talk down the economy, besmirch Wall Street and corporate America, but tells us we need to invest in the stock market. He gives Hamas nearly a billion dollars, and wants Israel to enter peace negotiations. He talks about curbing energy consumption and getting off of fossil fuels, then takes Airforce One, while criticizing corporate exec's for using private jets, to Denver to sign the stimulus bill, using 10,000 gallons each way. All to stand in front of a solar power cell company. A company by the way, that needs a bailout even though they can't keep up with production, because of socialist business policies. He insists the stimulus bill be signed by Congress on Friday, due to the urgency of the crisis, but waits till Tuesday to sign it into law. He expands the SCHIP program to include children up to the age of 30 who's parents earn up to 80,000. The government doesn't seem capable of operating anything efficiently or with any level of quality, yet he's bankrolling Universal Healthcare.
