That's a tough call, I would have to say both are at fault. But as far as who gets prosecuted I dnt know who should receive the punishment.

Why blame the parent for their childs mistake? I never did understand why parents sometimes get in trouble for the actions of their child. I know its the parents responsibility to teach right and wrong but in the end a they make their own choices

Whomever took the action should be charged. Period.
Even parents with the best intentions, who try their best to
raise their children the right way cannot nor should be held to
account for a child's stupidity.
Ok but a 9 year old in your thougts is accountable for his actions? I believe the parents need to held accountable for his actions but for the 14 and 15 year old should stand up to what they did.

I do not know the story but.... why does a 9 yr old have a cell phone?
Yeah, even if the child is 9. The parent didn't take the picture and
unless someone can give incontrovertible evidence that the parent
instructed the child to do so or instructed them that that is
acceptable, the punishment again falls on who took the action.
Yes, I know that seems harsh, but kids today could use a little
more harshness and a whole lot less coddling.
Simple solution, don't have kids!

However, when we give kids adult toys and then they act like adults who is to blame? No, they did not instruct him to do those things but what did they do to prevent them?
I agree kids need less coddling, however parents also need better parenting skills.
No argument there. Be a parent, child wants a friend, get them a puppy.
So just because the parent have a child a gun does that not mean that they shouldn't be held accountable if their child kills another child? In other words your argument is you have him a cell phone but didn't tell him to shoot porn with it is the same as if you gave your child a loaded gun but didn't tell him to shoot anybody is a good enough excuse to erase the blame off the parents for not teaching them right from wrong and making sure they know better? Plus wth does a 9 year old need with a camera phone anyway?

This is a straw man argument, at best. A cellphone is not inherently dangerous
whereas a gun is. Any adult who gives a child a loaded firearm and that child kills
someone else should be charged to the fullest extent of the law as it is
irresponsible at least, and accessory to murder at worst.
Your comparison would make more sense if it were apples to apples as
opposed to apples and every damn thing in the market, except apples.
The comparison was for a crime to a crime.

And it is still not a valid comparison. There is a matter of degree, expectation
of danger, harm or death. You cannot compare taking a naked picture to
taking a life and be expected to be taken seriously.
Ok the point is, should the parent be held accountable for the childs crime? Be it the crime of killing someone or the crime of sending nude pictures? Is any court a crime is a crime no matter the degree. Why skirt the issuie and say that they do not compare if they are both crimes?

I am sure that (until now) most parents did not think that, "Now Billy, don't go taking nude photos of your friends with this phone." was a needed comment when handing your child a cell phone.
The reason that you cannot legitimately compare the two is that one is an obvious dangerous weapon and the other is......well.............a phone. I am sure that the parents of this child, like most, gave them a cell phone to help keep them safe. However, if you want to go with a crime is a crime is a crime, then what charges are being placed on the girl in the photos? I don't know this story and to be honest I can't find it online, so I don't really know what happened. If the boy should have the book thrown at him and his parents too, then what about the girl and her parents? Should her parents be charged for not informing her that underage nude modeling is wrong? Should she be charged because she was involved? Was she an accomplice and a willing participant? Should she be charged as such? Should the cell phone company be charged with distribution of child porn? Did any of the police or the people in the court look at the photos? Should any of them be charged with viewing child porn?
Of course most of my above comments are a little (ok a lot) over the top, but you get my point. Just as you said, there are degrees to crimes. A speeding ticket does not get the same punishment as murder and giving your child, who uses poor judgment a cell phone does not equal giving a child a firearm.
I would like to comment further on the main part of the topic, but I cannot find anything on this. I see a bunch of stuff about 15 year old kids, but nothing on 9 year old kids.
To the original poster...this 'case/predicament' that you're presenting must be a 'hypothetical' one simply for the sake of discussion. If so; that's fine.
I don't see any grounds of legal merit on how the parents can be pinned with charges and possible punishment as a result of their child viewing pornography on their phone. So although your reason for starting the thread may be on a moot discussion...it's a discussion that is baseless.
Now as for the parent(s) being charged for the gun posession in a minor's hands...yes; there is fertile ground for a case. Comparing a child viewing pornography on their cell phone to that of a child posessing a gun belonging to their parents...is truly not on the same pitch.
I never knew that when a child view's pornography on their phone...it is an act of 'stupidity' as you label it.

Well this is going to be a case that's going to be thrown out of court. Then again there may be other variables or a set of outcomes that resulted in the child's posession of pornography. All the set of factors and elements are not known.

You missed my point. I never said viewing pornography was "stupidity" (although
I do think it is, but that's another discussion). The point I was making was that
a child taking, or allowing to be taken, naked pictures of themselves and then
being surprised when other equally immature children pass them along is.
You never had elaborated your point to even be able to say I missed your point. HOWEVER; now that you went in-depth and clarified what point you were making...well of course a child is stupid for allowing themselves to have naked pictures taken of themselves (whether they're the ones taking them; or allowing others to) and then sharing them on top of that.
From my understanding (based on the very limited amount of details the OP stated)...the child was either viewing pornographic websites on his/her phone; or s(he) was sending and receiving pictures of a pornographic nature.
The child was charged with cell phone porn distribution for passing the video of a 14 year old girl and a 15 year old boy having sex. He was sending the video to class mates.
