- Iight so i've recently have gotten into a car accident which ****ed up the the right front side of my car. I (the driver) and the passenger in the back seat came out ok but the passenger in the front seat got a cut around his eye and kinda messed it up.. So my insurance will cover the medical for the passenger and so far it looks like the passenger is healing pretty quickly, He regained vision in his eye after about a week and a half and everyday its getting better.. But now i hear he's starting to take acupunture bull**** which is not needed at all considering the original hospital exams showed the only injury he had was with his eye. Now i want to know if my insurance doesnt cover him for that **** is it possible that he can sue my insurance or me? Also after gettin back my quote on my car from the collision place it turns out the front steat passenger was not wearing his seat belt.
Now if he decides to sue can the fact that he wasnt wearing a seatbelt make a difference?
also Im in NY and in NY it's a state law that front passengers must wear their seatbelts. the passenger is an adult (20 yr old)

i don't think you'll have a problem with the passenger suing, doesn't mean he won't do it. but it seems like he doesn't have any case against you if the body shop can prove he wasn't wearing his seatbelt.

They are also very good about not paying for anything that is not required and medically necessary.
There's nothing you can do to stop him from suing the insurance company and I wouldn't try, because his lawyer could wind up suing you as well. Your company will fight the suit, and it should not affect you or your rates (although I don't know who your company is).08-11-09 07:51 PMLike 0
