The point is to establish a market for this alternative API with less restrictive requirements (perhaps with a modified Android CTS) which rethinks the UX requirements. It is possible, as part of what ART does when it installs software, can evaluate the resources incorporated with the app and modify the appropriate aspects of the app. This should be part of the design not an afterthought.
OM could start with a Google device and see what kind of anticompetitive arguments they can have if Google objects to another store on its GSF licensed device. Maybe, by the time the suit it resolved, it can intentionally drop its GSF license and have certifications for the AOSP based replacement by then. Maybe, further, the suit would be effective publicity for the company.
