    Is your Blackberry Torch connected with your company BES? If it is, no way around it until RIM releases it to be BES compatible

    This happened to me as well and I did some research. First I found a KB article:
    KB25065-Unable to use BlackBerry Protect when the BlackBerry smartphone is active on a BlackBerry Enterprise Server
    So it seems the problem is a rouge IT Policy. That led me to another KB article:
    KB14202-How to remove an IT policy from a BlackBerry smartphone
    So I tried this and unfortunately it didn't work for me but it might for you.

    What did work for me was using BBSAK and going to the Misc tab and selecting Factory Reset. Please backup you phone before you do this. All data is wiped. After restoring, I had to reconfigure all my 3rd party apps, but BB Protect now works.

    That error has nothing to do with having or not a data plan. He would get backup failed with a message that the service is temporarily disabled if he had no data.

    crackutil will remove the it policy as well, make sure you do a full backup before though as it will wipe your phone.

    You are welcome! I am glad I can finally start paying back the community. I have gotten so much help from everyone here.

    As was stated, Blackberry Protect does not work on BES (yet) but it doesn't mean some of us don't have a rouge IT policy causing problems. My phone was on a BES and I wiped it and installed the OS from a different PC. Not sure how the IT policy got on there.
