oh nah. the phone is not bricked. i pulled the battery and it was loading up as i was taking the pictures. Yup, I was well informed of what the condition was. I guess I don't really know what the definition of "new" is.
I believe I can leave negative feedback because this was the sellers FS ad...definitely not advertising what they are selling

Even the "pretty new" part is debatable, he answered your questions. You weren't specific enough in them. "pretty new" could have referred to the functionality of the phone, not cosmetically. And he meant that it was new becuase it was used for 3 weeks. not "new" as in it looks new.
If you had paid $350, and received that device thinking you were getting a BNIB Bold, you would have an argument.

What are you talking about, he can leave negative. The email says the seller said there were no nicks, regardless of what he paid, if he said there were no nicks and there are nicks, I would leave negative feedback, regardless of price.
