This is a fresh replacement from T-Mobile, so there are some very minor scuffs on the battery cover, hence the 9.8 rating. As always, there is no way to tell with certainty whether this is a new or refurbished phone. The plastic protectors it has on it are the same ones that come on the phone new, but I cannot be sure.
