I have an AT&T unlocked curve 8310.
I am using it with a diff carrier
(Fido---- they do not have the OS in the download section--North America na.blackberry.com/eng/support/downloads/download_sites.jsp)


If I update the phone with the AT&T os will it lock back my cell?

Your 8310 can be upgraded with any carrier approved OS, but they will all be v4.5.xx. The version 4.6xx is only used on the Bold.

Locking is a separate operation from an OS upgrade, there will be no change to your unlocked status.
