my wifes curve is acting up with trackball issues and camera issues. she has until Jan.1st to get it replaced by Verizon under the 1 year warranty. i was hoping they would run out of the Curve and they would have to replace hers with a new Curve 2. any chances of them running out of new units before Jan 1st?

given that they still offer the 8703e for sale, which is almost 2 years older than the 8330, I don't think they will run out of the 8330 any time soon. Also, the original Curve series is still one of the top selling smartphones.

If you can get it replaced under warranty 3 times in 90 days, you can be eligible for a multi-fru, which means you can choose a brand new phone that is comparable to the Curve.
It might be possible that they are phasing the 8330 0ut. My wife's 8330 was acting up and I brought to my local Vzw store and the rep wasn't even sure if they had any 8330s in stock. They did, but it didn't matter. I got her the 8530 anyways.
