I think it's established on an individual basis - I could be wrong though.

Rule of thumb is if you are on a 3yr agreement, you can generally upgrade 6 months before the end of your contract, and 3 months for a 2yr agreement.

There currently are no aggressive offers out there to entice regular phone users to go to a data device.
