The argument to be tested for the consumer: is there enough differentiation in the name (Polaroid Q10 tablet) to set it apart from a BlackBerry Q10 smartphone? But that aside, from a pricing perspective: very nice.

I'm sure there's nothing to stop BB wasting money on lawyers, but I doubt a case would succeed.

Even if BB had trademarked "Q10" (did they?), an important hurdle to overcome is whether anyone could reasonably be confused. I doubt any court would find that any average consumer would be confused between a 10" Android tablet and a smartphone with a physical keyboard. Confused enough to be "fooled" into buying the wrong item?, I don't think so.

I am guessing the z10 or Q10 names are not copyrighted. ZTE are releasing phones that are names S3 and 5S as well. There probably is a reason why they can do this

In all likelihood people googling this tablet will hear of the phone. I'm not so sure this works against BlackBerry.

My guess is that BB wouldn't have a case. If LG is able to name a smartphone the G2 when there was another Android smartphone named the G2 made by HTC in 2010, then I think Polaroid could get away with naming an Android tablet the Q10 even though BlackBerry already used that name for one of their smartphones.
