    Miami U.S. District Judge Robert Scola had choice words for Apple and Google during a patent dispute between the pair, accusing the two of of having "no interest in efficiently and expeditiously resolving this dispute" and instead using such proceedings "as a business strategy."
    There seems to be a glimmer of hope in this fuster cluck.

    Is this a surprise? Apple were the ones who invented this strategy (& people say they don't innovate :P )

    Judges can complain all they want, but there is not much they can do about it, their hands are tied until laws are passed overhauling the broken patent system

    Concur. The US is the most "sue-happy" place on the planet. Trial lawyers are one of the few ever-growing professions here. All efforts at tort reform here have been shot down in balls of flames. Lawyers cut nasty little deals with other lawyers and insurance companies to keep from being counter-sued, and so the lawyers continue to rake in the cash whether they win lawsuits or not.

    Why wouldn't Apple take advantage of that?

    Companies were suing eachother apple even entered the market. In fact, HTC took the first shot at apple.

    As JasW pointed out, this has nothing to do with tort law. Bu even if it did, the claim that "all efforts at tort reform here have been shot down" is simply untrue. See individual state limitations on medical malpractice damages and/or the enforceability of contractual, binding arbitration clauses in contracts (clauses which apply not only to possible breaches of the underlying contract, but to torts caused by those breaches)

    Well, for one, Apple isn't a law firm, so when you say "why wouldn't Apple take advantage of that" what you mean is "why wouldn't Apple pay its lawyers just to make someone else pay theirs." Ultimately, I believe that Apple would rather have its IP respected in lieu of filing lawsuits. I also think that Google and/or Samsung would much prefer to have the success they've had without infringing on anyone else's IP. Obviously, neither of these is going to happen.

    So many things wrong with what you wrote.

    To start, the claims between Apple and Google are not Tort claims so I have no clue what tort reform has to do with this.

    You are also wrong about tort refrom. Many states have adopted meaningful tort reform measures.

    Also, any lawyer who cut a deal like the one you are describing would get disbarred.

    Other than these small points, you nailed it.

    Thanks for the correction, dad.

    Even so, my point stands regarding lawyers in the US and out-of-control lawsuits. Only a lawyer could possibly disagree. Is it safe to assume you are one?
