Since we all know apple is suing all or most of the android makers however can RIM sue apple for the iMessage similarity to BBM?
Is just a question I asked my self since apple is suing for patents and similarities.

Lol...if that's the case, ICQ should sue all other IM clients.
imessage isnt similar to bbm in my opinion :p it sucks :p and if they sue them for imessage, i think they will have to sue whatsapp too lol. Anyways i dont think RIM can afford to go in any patent fights right now.

It's similar in the respect that it's platform-specific. Past that, I don't think there's anything else they have in common. BBM has its own separate icon and integrates with the Messages app. Texting contacts can be added to BBM and those will show up in both BBM and the SMS/MMS app, but not Messages. With iMessage, there is no separate icon to launch it since it's intergated with texting - iMessage contacts will show up as a different color from regular texting contacts. Different implentations of a platform-specific messaging app, therefore not likely to be brought before a court.
it will not happen. rim 3 bil vs Apple 600 bil cap. apple would just outright buy rim. would be cheaper than paying for any settlement.

I know that never would happen, but since apple is suying companies for similarities. Whatsapp is an app for every os, comparing to the intentions of bbm and imessage that are integrated in their os.
Wouldn't even make it to a jury. Both apps have the same general purpose, but iMessage is worlds different from BBM.
No the "concept" of BBM is not patented. The methods by which they employ BBM are however patented.
iMessage has its own build design and function and back end. BBM is loads more powerful and refined. BlackBerry has more social influence on 'what apps we want' let's get real. Look at the app store on iOS Whatsapp, Kik and all the other instant messenger platforms. Aside from QWERTY BlackBerry pioneered other mobile fronts as well.
Let's remember who stole whole idea.

Well one of the designs for the iphone 5 could get apple sued as it looks very much like a blackberry torch.
Sure they can sue them. The correct term for RIM suing Apple would be "corporate suicide".
RIM have had to settle A LOT of lawsuits for violating other peoples IP, they couldn't afford to risk the counter suit.
Well RIM had the money to sue Kik over bbm patent infringement didn't they??

Not even in the same league as a suite against a manufacturer, let alone Apple. Even IF RIM had something they could guarantee to use against Apple (and BBM/iMessage is not it), the estimated legal fees from the Samsung/Apple case are in the hundreds of millions. RIM cannot afford, at this point, to go anywhere close to that. All Apple would have to do is stall.
Considering the founder of KIK worked on BBM development which gave him the knowledge to create KIK and that KIK had/have no counter suit it made sense. Apple would counter sue for countless violations I'm sure. As I said, RIM couldn't afford to even if they wanted to.
COUNTLESS VIOLATIONS???

They've got bigger fish to fry. RIM isn't worth their effort.
The whole concept is flawed. Bringing a case to court is the last resort after all other lower risk strategies have failed. The only winners would be the lawyers, who get paid regardless of which side wins.
Dude! Don't be so sensitive. They would come up with countless violations. I'm not saying that RIM is guilty of any violations. It's just how the game is played.
