BlackBerry Gives Apple Another Brazilian | Sharpened Sticks | Tech satire with a point

OTTAWA, ON � You may no longer be able to buy an Apple handset called an �iPhone� in Brazil and in Canada your iPhone may no longer be allowed to carry the brand name �Apple�.

A recent ruling by Brazilian copyright regulator Inpi has stripped Apple of its �iPhone� trademark in Latin America�s largest market. Moreover, a move by the Canadian Intellectual Property Office could have an even more chilling effect worldwide. The original filings for the BlackBerry 5810, the original RIM�s first phone, contain a codicil providing the rights to all phones named after fruit. The inclusion of the Latin terms Plantae and Rosacea were uncovered as the resurgent BlackBerry was in the process of preparing a legal defense against patent trolls. This verbiage had ostensibly been regarded as little more than legal boilerplate for more than ten years, but the new in-house corporate counsel, , Chief Legal Officer of BlackBerry Steve Zipperstein, quickly realized he had struck gold. The preliminary ruling handed down by the regulators late last night sides with BlackBerry insofar as the original filing predates Apple�s entry into the market, a generally available product resulted (the 5810), and the language encompasses a specific kingdom and family of fruit, including both the blackberry and apple. The ruling covers all models of iPhones and iPads with an embedded mobile transceiver (3G/4G/LTE).

�We�re reasonable folks� said Zipperstein �We don�t want to keep every fruit name for ourselves. If some computer company based in Cupertino, CA wants to call its phone Persimmon or Grapefruit, we have no objections�. Apple refused to offer an official comment on this latest legal setback. However when the ruling was presented to an unnamed high ranking insider, he reportedly asked �Is this some kind of a joke?�
