My mom has been obsessed with my berry since i got it, i dunno but recently shes been interested in tech gadgets. So i figured i'd get her a berry for either christmas or her birthday, which is January 9th.

Prices may drop during the holidays but everyone's always clamoring to get their gifts, i want to make 100% sure that i have it and not risk it going out of stock. I'd like you guys to keep in mind that im also interested in buying a javelin when it comes out next year- and NO, i will not give my mother a hand-me-down berry for her gift lol... thats for my little sister. So...

Would it be better to buy her present now, during, or after the holidays?

her contract was up this past summer. so i suppose she can go up for an upgrade as well, you make a good point. arent the prices better if you start a new number, than upgrading?

Not necessarily. Accounts in good standing, especially long-term accounts, often receive great upgrade discounts at contracts end in the interest of customer retention. You'd be surprised at what most carriers will do to keep you as a customer.
