Amazon purchased BB is stolen!

I'm writing because I just found out that the 8320 I bought through Amazon stopped working a few weeks ago. The BB Messenger wasn't working, and the data plan was on/off. I had recently been experiencing some trouble with the O.S, so I updated it, and now the data plan won't even work. I called my carrier and apparently 2 weeks ago (before I updated the O.S), the PIN was listed as stolen, so I can't even register it with any data plan. They cannot tell me WHO listed it as stolen, but it wasn't them, so they told me to call my seller.

My question is, is there a possibility someone may have misreported a PIN letter or IMEI and thats why this is happening? I'm calling Amazon and they don't want to take responsibility, nor the 3rd party seller who advertised the product. Who can I call to verify the PIN listed as stolen? Does RIM have some sort of hotline? I've been searching with no success :( Maybe the cellphone isn't stolen and someone mistyped a letter, or for some reason automatically reported my PIN as working. I say this because I had been able to use data services (including BBMessenger) for 2 - 3 months before it stopped working.

Oh, and a word of advice, NEVER PURCHASE A CELLPHONE THROUGH AMAZON.

You didn't buy it from Amazon. You bought from a 3rd party on Amazon Marketplace. Amazon is NOT directly responsbile for it.

You only have 1 option, file a complaint with Amazon against the 3rd party seller. They can help you with the dispute, but there is no gurantee of the outcome.

Yeah I did that already. But Amazon should be held liable as well, they can't let any random person sell whatever they want on their webpage. If some 3rd party seller starts selling drugs, Amazon should also get punished. But I guess they don't have a proper screening process, and they get a nice juicy cut for every purchase the 3rd party seller makes.

So, no ideas on a direct line to RIM or something? Nothing which can be done?

I disagree. Amazon is not responsible. You bought a stolen phone from a store, is the mall operator renting to the store responsible. Is the credit card processor that handles the credit card transaction reponsible.

You got screwed by the seller and suffered a financial loss. Don't hold Amazon, RIM, or your carrier for your mistake.

If you bought it from someone on Ebay, would you hold Ebay responsible? No website has the resources to screen every product sold by every vendor on their site. Do you expect Amazon to check every single product that is sold on their site? I'm sure they screen the listing before it is made public to ensure it is OK but they are not going to check the serail numbers, imei numbers, etc. of every product sold on the site.

Read the Amazon conditions of use (there is a link on the bottom of every page on the Amazon site). Here's the excerpt that applies to you:

Even if Amazon did screen the products, they can't predict that 2 or 3 months down the road, someone will report it as stolen. If it had been stolen at the time you bought it, you wouldn't have been able to activate it.
