You said it yourself. You're using the 9700 case. That's the problem. The magnets aren't lined up for the 9800 in the 9700 case. Snag the 9800 case from the store on here and problem solved.

It does, but using the case for the 9700 the magnets do not line up with the Torch to put it to sleep. There are threads on this forum discussing how to move the magnets.

    your problem is the magnet..
    here's a little experiment..
get a magnet from your refrigerator.. or any magnet for the matter.
now put it close to the Torch screen...move it from the top of the screen going down
and you will see how the magnet put the device to sleep.
that should be the location of the magnet in the holster that you're using.

I was using my 9700 case until I got the OEM leather holster for the Torch. Get the Torch holster and be done with it.

Lies, I had the 9700 case and also magnets would not align and the screen would turn on inside the case. Guess I gotta shell out $40 for another $%&*$ case.... Oh well. BB should have provided this with a case.

is there a setting somewere i can change it stay locked when i take it out?

The magnets in the 9700 do not align properly whereas those on the Torch do.
