First off, I love this phone. I am coming from the captivate. While the captivate is a spectacular phone, battery life and gps issues where a deal breaker for me. In the past I have had a blackberry 8310 and 9700, as well as the iphone 3g.

Now to the issues. I have used search and came up short.

Issue 1: the touch screen goes wonky sometimes. I wasn't sure what it was at first but after alittle bit of testing I discovered that it acts as though I have my finger down on the bottom left hand corner of the screen so when I do actually touch the screen it tries to do multi touch or it just doesn't work at all.

A battery pull fixes the issue for a few hours.

Issue 2: the battery % under statistics sometimes gets stuck. I noticed it while it was charging after about 5 hours it was still at 85%. After a battery pull it was at 100%.

any ideas? Should I take it back and get a different torch?

First idea would be OS upgrade (if you're not already on 337). maybe a re-install. Otherwise, it sounds like it could be hardware (return!)

Will an OS upgrade void the warranty?

.246 is the latest certified version on AT&T, but oif you look at the top of this forum, you will see a sticky where you can download .337 frrom another cell providers site. (Beeline I believe)

.337 is very stable on my AT&T torch and I am not experiencing any of the problem you state above.

I willing to bet you have a hardware issue however that will not be fixed by upgrading the OS of the device.

Replace it first and then update the OS to .337 if its still on .246. Works great alot better than .246
