    I dont know if you guys recall the class action lawsuit against apple for the 1st gen ipod nano, but a ton of people received settlements when that finally went through. Has this idea been put up in the air about the Storm and Verizon. I mean this is honestly a sick joke already. I wish I did not sell my curve. We definitely have the overwhelming support to put something like this together. thoughts?

    Each member of the class got $15-25 because the iPod scratched easily. Is there a fault of manufacture of your phone? My phone is pretty indestructible.

    Can you prove that any bugs in the software have caused you harm? Spontaneous reboots or failure to get "official" updates are not torts in and of themselves.

    No, I'm not a lawyer. Any attorneys want to weigh in?

    They can let me trade my Storm in on a Storm2 or a 9630 for credit equivalent to the subsidy Verizon puts on those devices. That would be fair treatment.

    Someone brought up the analogy of a faulty car.. There's things called Lemon Laws that cover bad-from-day-one cars. Perhaps we need a Lemon Law to protect consumers from other DOA items, like giving people an out when their phone is demonstrably sub-standard, or won't truly live up to the performance portrayed in advertisements and trade shows.

    Why didn't you just return it within the 30 days if you hated it so much?
    And you can still send it in under warranty if you feel there is something wrong with your phone.

    are you serious? class action law suit????? in all fairness yah the.75 os is a lil sluggish and can freeze up but it gets the job done. Whats the basis for the lawsuit. "when i look at porn on my phone it freezes" " i had to do a battery pull" get a life, get real you dont like the phone sell it and buy a curve again. YOU GOOF

    My Storm definitely has some issues. Mysteriously dropped calls all the time.
    The audio quality on phone calls is terrible.
    All the other bugs I can live with since it is a new device. But the thing really needs to work as a phone.

    And all the suggestions to buy another RIM device are stupid. Why would I buy something else from them when they couldn't get this one right?
    I let the 30 days go by because I really like the device and want it work and keep applying the leaked Os hopong that will fix it.
    It is getting better but still not there.
    I had a dropped call with a new customer the other day while I was standing still. It was quite embarrassing.

    Sigh. Class action might be going too far but to keep saying this thing is fine is too far also.

    Just wanted to put my 2 cents in. I LOVE my storm. Even when I was running .75 my storm ran great. I upgraded to .113 have couldn't be happier with this phone!!!!!!!!!!

    I really don't think we have a case with the storm. All I can think of is the class action suit that was brought to Verizon with respect to the Motorola V710. I don't know if you guys remember that phone it's pretty old and insignificant. The reason behind the suit was the fact that Verizon disabled bluetooth file sharing on the phone, despite their ads saying otherwise. So in effect they were advertising a feature on the phone that they purposefully disabled. Here's an excerpt:

    The Plaintiffs claim that Verizon Wireless did not accurately disclose that certain Bluetooth features were not supported by the Motorola V710 handset available with Verizon Wireless cellular service. Verizon Wireless contends that its marketing materials were not deceptive and accurately informed customers of the Bluetooth profiles available for the Motorola V710 cellular handset available with Verizon Wireless service.
    In the settlement VZW gave people three options:

    1.) A $25 service credit;
    2.) Termination (without fees) and a full refund (with proof of payment) or $200 (without proof);
    3.) Entitlement to purchase a new phone, however this was limited to the lesser of the amount you spend on your new phone and accessories or the amount you paid for the V710 and its accessories (or $200 without receipts).

    Either way, we don't really have much of a case here, because even though the OS on the VZW commercials for the Storm show a completely fake and what seems to be impossible speed on the Storm, I'm almost certain they put that warning in their commercials on the bottom of the screen that say something to the effect of "This is a simulated image," etc.

    But hey, if you can come up with something, you DO have support because I know three people with the Storm who are in fact very dissatisfied with their phone. Don't expect many people on Crackberry to back you on this because this community is very knowledgeable and due to OS leaks and such, they can avoid alot of the headaches that the average Joe still suffers with the Storm. I honestly just want my phone to be snappier, I'm running .141 and I still have memory/speed issues...all of this should have been fixed by now. I wish we had more support from VZW.
