I usually wipe my phone with JL commander before upgrading. I always do a back up through DM and back up 3rd party aps as well.
Question:
Is there a way to back up your layout and settings? Or am I do the back up wrong?

You probably aren't doing anything wrong. The backup process only backs up your personal data. The 3rd party apps process backs up 3rd party apps. Device settings aren't included in either of those. It's an interesting thought. Maybe somebody could write a "Mirror" app that would just image everything. I'm unaware of such an app, and RIM might not permit it anyway.
