I don't know UK laws and carrier contracts, but you can certainly do this in the US. Just make sure that if you have monthly device payments for the Q5 (i.e. mortgage-like payments you're making on the price of the phone, in addition to service--somewhat uncommon,) to keep making those. Also, don't cancel the contract or fall behind in your payments, or you'll leave the poor guy with an expensive paperweight.
