I have come across this in a few threads where the op is advised he may have a refurbished playbook.

I understand that in both Canada and the US it is illegal for a company to sell a refurbished unit as new.

Are retailers doing this? And how would you know?

The only place I would suspect such a practice is on that scamfest of a web site, e-bay, where the greater the lie, the greater the chance buyers have to be rightfully cheated. Anybody who uses e-Bay and gets cheated deserves it, IMHO. Other then that, stick with the manufacturer or big box stores to avoid that pitfall.
