But you may also want to check with BlackBerry also. I recall there was warranty issue's a while back for people who purchased outside of BlackBerry's certified retailer list.

actually, this got me thinking...one month seems very short for a quality device like the passport. I read the pdf on their website and it says handhelds are covered for one year. I dont know if there are some exceptions to this rule but I bought my phone in december, direct from sbb during the 3-week black friday sale and in january I called for support, was asked to enter my imei, and then told my device was out of warranty... but for $35US I could purchase a one-time support call. I hung up and fixed the phone myself, luckily it was nothing but a piece of gold foil from a cheap sim card shorting out the pins...no damaged done. but wait a tick...is my phone still under warranty?!

One month if you don't like it or replace with new phone. One year warranty but that would also mean fixing your phone and only replace if not fixable.
But that is if you buy from BlackBerry listed retailers/distributor.

FYI, eBay provide 1 month protection if the device does not come as listed description. If buyer pays by Paypal, Paypal provides a 6 month buyer protection.
I think that eBay definition of New is pretty clear. Refurbished devices have their own categories. If you buy new and receive refurbished, you can get your money back as long as you can prove it.
And as someone mentioned, ask the seller for info before buying and keep all the response as proof.
It's eBay mate. It's not your carrier vendor.

that's well and good and understood for e-ebay purchases, but I bought mine from blackberry and I think they shafted me. still, it worked out for the better since I didnt have to send in my phone and wait an infinity to get it back..

Looking back I wish I had jumped on this deal. Doesn't look like anything better is likely to come along in the new future as stock (or people willing to part with them) gets fairly low.
I bought a brand new Passport that was advertised as UNLOCKED; however, it was not. It came with an unlock code, and (I never unlocked it) I returned it.
Here, it seems, it was locked to a European carrier (name unknown) and the seller told me that "all international BlackBerry phones need to be unlocked with a code... blablabla... other of the European brethren told me otherwise... that their BB's needed no code in Europe.
So, lesson learned.
And another reason why Factory Unlocked devices are the only devices I'll buy in the future.
