And also if I would get charged if I use it and I dont have a data plan?

Yes, you need a data plan to use it.
IF you are able to even connect at all without a data plan, then I'm sure you'll be charged on a pay-per-use basis. However, since it goes through RIM's network, I don't see how you would be able to without a BlackBerry specific data plan anyways.
