- ok i have read several places on this forum that esn cloning is illegal, however i have reviewed the ffc regulation/law and to sum it up it basically says that Cellular fraud (cell fraud) is defined as the unauthorized use, tampering, or manipulation of a cellular phone or service for purposes of commiting a crime, then goes on to be specific into subscriber fraud and for what purposes cloning is illegal. Now that i have read this, im at at loss as to why anyone would think cloning your own phone to have 2 to use for oneself is illegal. As a matter of fact it doesnt mention this dynamic of the arguement at all. i am only interested in this because i want to clone the esn of my crap phone to my flashed verizon blackberry so it can use phone service and texting. (metro pcs recently decided that they arent going to take blackberrys from other providers anymore.
so if anyone has any information about this topic plz respond as i am interested in a way to clone the esn.
Thanks for your time01-28-11 08:36 PMLike 0 - That's not what it says.
Cell Phone Fraud
Cellular fraud (cell fraud) is defined as the unauthorized use, tampering, or manipulation of a cellular phone or service. As a result, the Wireless Telephone Protection Act of 1998 expanded prior law to criminalize the use, possession, manufacture or sale of cloning hardware or software. Every cell phone is supposed to have a unique factory-set electronic serial number (ESN) and telephone number (MIN).01-28-11 08:48 PMLike 0 - you only copy pasted a part of the fcc regulation but the Wireless Telephone Protection Act of 1998 that is referenced says "The Wireless Telephone Protection Act (Public Law 105-172, 112 Stat. 53-55) amends the federal criminal code to prohibit knowingly using, producing, trafficking in, having control or custody of, or possessing hardware or software knowing that it has been configured to insert or modify telecommunication identifying information associated with or contained in a telecommunications instrument so that such instrument may be used to obtain telecommunications service without authorization. " ref: glin.gov/view.action?glinID=62004 Global Legal Information Network
which clearly says "obtain telecommunications service without authorization"
im am paying for service and it will be used for development in connection with a lawful purpose. im not going to use the old phone im only wanting to be on the blackberry instead. the carrier is the only one protected by the law not the manufacturer. im not frauding the carrier at all.01-28-11 09:54 PMLike 0 - It does not matter who is in possession of the illegal software or the cloned device. It is still illegal.
You cannot alter the VIN on your car, even if you do not plan to sell the car to somebody else. It is the same type of law here.01-28-11 10:14 PMLike 0 -
