Of course! Wouldn't you want a device in perfect condition? Go get that new bold!
There's an easy fix that won't void your warranty. Open up the keyboard and when you reasemble it, make sure the keyboard lies 100% in the centre. Worked like a bomb for me. I don't think you should get a replacement

In order to take the keyboard out and realign it as you say surely you need to remove the 2 retaining screws that sit under the plastic bar that has the operator branding on it? Which will invalidate the warranty.
I'd send it straight back if I were you.
Send it back! It's supposed to work for you in tip top condition. If its sunk in,might as well have it replaced. It's not the way it's supposed to be anyway. :)

You should try to pry the track pad up with tweezers first, if it doesn't work get another one
Does the trackpad work? I'm guessing it does. Mine is below the menu/back button by a hair. If the trackpad works it's not defective.
