    i received mine completely sealed. everything was in its own individual packaging or plastic. if the box was unsealed and the battery was out of its plastic, it was opened and used. i would personally go to a verizon store, as is, and seek advice from there.

    Personally, I would make the store aware of the issue and let them decide. If they offer you a replacement then all is good. If they dont, ask them to record your concerns so that if there are any issues outwith your return period then you will want a few days extra grace to return it.

    In years gone by, an unsealed battery could be a bad thing, it may of been abused but I dont think thats as relevant these days.

    You could maybe use this as a reason to get a new battery out of them, with the hope of keeping the original? ;-)

    same thing happened with my wife's "new" car. Someone else had opened the door and we returned it and got another one.

    mine too came like that from the carrier but i didnt bother at all because i tested everything there and made sure all the accessories were complete before leaving with the phone and all has been fine with the phone.

    just looked at my brand new unopened 9900 that i cancelled, which they still sent, has been opened and then had new tags stuck on it.

    I have to go into town today any way, I will stop by the Verizon Wireless Corporate Store just to see what they say. I figured the battery would be sealed and it was just plopped in there.

    Look guys, here's what you need to understand about the FEDEX shipping process for on-line orders. These things are already on a warehouse shelf in Memphis, all boxed up and sealed in FEDEX delivery box. If anything has been done to the phones before being sent to FEDEX for stockage, it's being done by the Manufacturer. As has been mentioned, OS updates, etc. When you order the phone, Verizon just sends FEDEX the instructions to pull one off the shelf and put it into their sorting facility for over night deleivery. It's not like these things are in a store somewhere and an employee is messing with it before its delivered. Chances of anything being wrong with it are slim to none, and if there is, it's covered anyway and you'll get a new one from Verizon.

    Took it to a Corporate store and they were kind of surprised. He ran the ESN to make sure it hadn't been previously activated and it hadn't. That would good enough for me. I'm going to charge it up and start to use it.

    I ordered an htc wm phone a few years back and it came with a homemade porn flik on the installed sd card. Worse part was the unattractive couple in the movie. Serious. Another guy on the forum said he had weird pics on his card, not the standard samples. So who knows who's playing with our devices before we get them open. And......did they wash their hands!

    How about maxipads? Those are sealed, and I don't think anyone has ever died from using one. They are sealed so you know no one has ever used it before. Would a woman use one that's not sealed? Nope.

    Another bad example. Now we're comparing a cell phone to a Maxi Pad? You ARE kidding, right?

    What next, you going to say that you're not going to go to Walgreen's and buy an open box of condoms? I hope not!

    Try selling a used Maxi Pad on eBay or Craigslist. Unless it was used by Lady Gaga, you won't get many takers. Put your "used" 9930 on CL or eBay and you'll make a profit (right now at least).

    Seriously folks, who do you think opened the phone? Why do you think it was opened? Do you think some curious person at FedEx or UPS was willing to risk their job just to get a peek at your phone? Or are you thinking that VZW is dumping store returns on you?

    Ok, so maybe that wasn't a good analogy. Probably all comes to personal preference here. I wouldn't accept it just for the fact it wasn't fully packaged, but if the OP and anyone else for that matter is comfortable with it, has an ESN check out clean and nothing else seems wrong, enjoy.

    It is working great, no issues to report. I definitely am happy to be back to BlackBerry. I'll be happier once the apps start to roll out.
