It is possible that the 10.3.1 update is not available through your carrier yet. Some folks have reported success with turning off their device, removing their SIM card, waiting five minutes and then checking for updates over Wi-Fi. If this doesn't work and you want to upgrade to 10.3.1 right away, you can do so using Sachesi (check the BB10 Leaked/Beta OS forum for a thread titled "[Guide] How to do Non-Destructive OS Upgrade with Sachesi").
Hello, I think I have the same problem. I up loaded the latest OS, which was 10.3....., and my phone was malfunctioning. after backing it up and re-loading the software, I'm back to the previous OS, and I too am told I have the latest software and there is no updates available..... now I can't re-load my previous backup! Very frustrating. I will try to help if I'm able to.....good luck.
