Default Should I include an EULA with my Theme

Hello, I have been working on a theme that I wish to sell in app world when I finish it. Should I include an EULA with my theme and how would I display slash get users to agree to it? I made my theme with theme builder and I dont remember seeing any way to include or display a EULA. Someone please help!

We asked RIM this as we are just starting out doing themes, they said you cant as there is nowhere in the theme studio to do so
