Default other sites stealing our themes!!!

I found out a few other sites where my themes were posted without been authorized by me. I know my themes are free but where posted here at Crackberry.com for this site users to enjoy, I didn't give any authority to other people to copy my work and posted at their own or even publish them anywhere else.
What happened with Crackberry's copyrights???

Please post your findings and what can we do about this???

PS. After finding this I might be removing my themes

CrackBerry holds no copyright to your work.

I don't recall ever seeing any terms and conditions related to posting/sharing themes here on the site, nor do I recall any exclusivity terms along the way.

Once you put a freebie out there, it is in the public domain and, well, you don't have any control there. Sorry. If you feel there is a legitimate infringing use of your copyrighted material, I can refer you to a very good IP attorney. But since you're giving themes away, my hunch is the legal fees associated with pursuing an infringement claim might change your mind about how vigorously you'll choose to defend your IP.

I know several developers who have had their work pirated and given away on numerous sites. And as someone who offers premium themes, I can understand the actual damage caused by that sort of piracy.

But let me understand here, you're giving themes away for free and you're upset because someone else is also listing your free themes, just on another site?

you are talking about free themes, whereas there are Chinese and Indonesian sites putting up every Premium Theme that I am posting into Mobihand, though I wrote couple of times to Mobihand , to secure their server, no response have been given to me from anywhere.

they are pulling every Premium theme that we developers are posting here.

Free themes are still okay but think of Premium themes pulled out , without even 1 customer hitting the original download button.

I am quite amazed at the server security of the Mobihand website and the CB Store.

Dont know when tey would be able to help us secure our themes on their server??????????

its not server security over at mobihand, its far worse than that.

as im sure youve noticed, at the end of the month you always have a set of refunds, normally the same person who has purchased multiple copies of the same theme. THIS is the persons stealing your work, and as they use dodgy/stolen cards mobihand cant do much about it right? well, not really, because i`ll bet you all the money iv ever made in my life, that if you look at one of those refunds, then look at the mobihand account in that name, the account is still open, so they can still download your software again and again and again!

THAT is why i left mobihand, and i`ll be honest i havent regretted it ever since.

So basically what you guys are saying is stop whining and deal with it. I'm just pissed and frustrated because I've put a lot of hours creating those themes and someone else is taking advantage of my work not giving me a single credit for it. Sucks but I guess that's the way it is.
I thought that part where it says (Copyright ©2000 - 2011, vBulletin Solutions, Inc.) here in this site, was to protect any publication but I'm wrong again.
So, is there a way to protect our work or at least cover our backs from people stealing it?

not saying that at all!! as i said iv had the same experience (and to be clear its not CB`s fault at all).
what i always do now is to add my own weblink into the theme, that way people know where it really came from.
sadly there isnt a way to protect your works in the sense you mean.

Weblinks break application hierarchy...

There is no defense...but contact the site admin and ask them to take down your work...for the most part they are usually cooperative.

Was thinking about water marking my web link, have to create one first but that's out of subject lol. Won't help but I do get the point.
Its just frustrating specially because I just started doing this a bit more than a month ago and put a lot of hours trying to create something people might like and after that more hours fixing bugs or just adding a few request, so really sucks but I enjoy doing what I do specially when people actually recognize my work

its not always someone re-downloading off mobihand... once someone buys a theme, you can just yank it off the phone and pass it around. I have had a number of mine stolen. very frustrating.

I am not quite convinced as I made a Theme for the Manager of a Company on his personal request, but as he wanted it come very fast to him via OTA, so I had to put it to Mobihand , and the person bought that theme for 20 USD.

Now I see when I googled around, that this theme is present at a Chinese site.

Now a Theme that has been sold only once, and bought by one reputed person cannot be taken by a Chinese site.

I guess I am speaking correct......Its only possible when Mobihand Storing the files in server location has a Particulat type id , and that has been recognized by these people , where they just change the ID'S and keep picking these themes as soon as they are posted in Mobihand server.

CB has got nothing to do with it, but for Mobihand, I guess the server security , if it were being changed , then these monsters would have to have scratched their brains for some time more to again hack the server .

Static and BBT.............I ll PM u some link, as you are masters in Theme Making.....
When you see that link , you would be shocked if you keep a regular eye on the same.

1 theme placed in CB forums....within minutes thats uploaded in this site .....with all files taken up.

i think i know the site you`ll send me to lol, either way, i complained enough to mobihand about that issue, plus the whole fraudulent transactions whose accounts are open, that i had enough. at the end of the day actions speak far louder than words, so i left mobihand foir good. naturally they have ignored my request to close my account, but what would you expect eh.

also, DC, yes weblinks do break the app heirarchy, and i should be clear that i dont use links in OS6 UI themes, but `custom` style i do as its not such an issue.

Thats quite correct BB , I have written about it to Mobihand too, but in terms of Service Charge they charge us with their due share , and as I am from India I also pay my regular taxes of 30% .

So Why is it that they cant give us our desired security and some mere Chinese people would come in and just hack their web server, and they would ignore to pay us with the desired security that our themes require from Mobihand side.

If this thing continues, then may be I will be also among those Theme Developers to stop sharing with Mobihand and start using some other service.

We need security to be higher, not just being hacked by some non sense people.

To know how much work and pride we put into these themes...and post it up for free...inexcusable.

Alright, I understand that you are all intent on fighting about who stole what and when and where, but CrackBerry is not the place for that. We are not babysitters and don't have time to sit here and watch over you.

No more fighting, no more fake accounts being made to slander someone's past. If said "someone" was posting stolen themes on CB they would be dealt with by the mods, but we haven't seen that happen.

You can all be angry all you want, but keep it off the forums.
