Well seems I'm not that lucky. Today I realized that my mobireach account is blocked. I cannot login or reset password. As a result I cannot support customers, I cannot pull off my apps.
It appears that they simply stole my applications. Should I shut down activation service? Thousands of buyers will be cheated as they will pay and do not get app.

Fortunately I was one of the lucky ones and received payment on the 11th which paid me up to date from August. I didn't pull any of my products, primarily because I didn't feel it was right to take this issue out on current or potential customers, but also because I didn't want to restart the clock as far as sales go. So hopefully this is a good sign that they're getting back on top of things *fingers crossed*
Have you tried using the "Forgot Password?" link on the login page?
I had an issue a couple days ago where I would enter my login info and it would reject it over and over saying that it was incorrect, when I was certain it wasn't as the information is saved to my PC. Last week I decided to contact mobihand again (via the feedback formula in the backend)... asking for my outstanding payment.
and what should I say - today the full outstanding payment (since Sep 2011) have reached me (obvious without any interest).

They owe me well over $2,000.00 and now everytime I log into mobireach I get "We're sorry, the service is currently unavailable"
When I click on Help I get "We're sorry, the service is currently unavailable"
When I go to mobihand and click on contact support I just get a blank screen.
So basically the is absolutely no way for me to contact them.
I seriously hope they have not stolen my $2,000.00
This issue has been going on for over a week, so it's not just a temporary issue.
Can any other developer still log into their mobireach account?
Does anyone know a phone number or email address for them?

D Mac, they owe me well over 20K USD. My dev account has been deleted without notice.
My lawsuit was filed in February, they defaulted even on the court settlement.

Hi guys,
I have been with MobiHand since 2006, and always liked them. In fact, I helped them debug some initial problems with their store and various developer features when they were introduced. I didn't get any payments from them (because of technical difficulties; I'm from Europe, first they wanted to pay by paypal which was not supported in my country, and after some time they wanted extra documents that were hard to get and unnecessary) and I did not press on them, probably being naive.
My apps were available in their store till the end as they asked, and I provided customer support until today as well. Having very nice experience with their store and staff, I always advertized their site and directed users there. I was not selling much, but all in all it's about $5,000 they owe me for 6 years (last purchase being made in January 2012).
My understanding is that the 70% they owe us must be a separate, safe part. When they go bankrupt, this concerns their 30%. If they touch the developers' 70% part, that would be stealing or whatever this could be called, anyway, a criminal action.
What hurts me most is that I didn't get any email from them regarding their problems (I was only getting "You Have a New MobiHand Order" messages so that I could send individual reg codes to users). Not even an email when they filed for bankruptcy. Such ignorance for so much support we offered.
Can you advise what we can do in this situation? I believe we should act together instead of individual actions - this way we are stronger and the whole thing gets simpler to organize. For a start, we should probably create a list of all developers who did not get paid. As far as I know, only PayPal mentions in the agreement that "vendors' money are held on special (escrow?) accounts and cannot be touched upon in the course of bankruptcy etc."
No other internet store/shareware registrar/payment processor etc. has this provision in the treaty. Not every attorney will be able to show that it was "stealing" and not "bad business practices, breach of contract".
Mick2, my situation is much worse, the debt is bigger, and they have been somehow selling my apps till mid August 2012. So I have several thousands of customers to support without being paid!
As for your other questions, it is impossible to sue a bankrupt (a company that filed for bankruptyc) in civil court. Worse, all civil lawsuits have been dismissed.Last edited by adeveloper; 09-26-2012 at 09:31 PM.

Sorry to hear that your situation is worse... My feelings are so bad because I lost everything.
Regarding mentioning separate account in the agreement, I don't see this as a mandatory statement. They do not have to say so; they say that 30% is theirs and 70% is developers', and that's obviously enough. Whether they keep it on a separate account or not, they have no right to use developers' money because they are not theirs. These 70% are someone else's.
In fact, even if they keep it on a separate account, this only makes a technical difference, because they can steal it as well. It's not the separate account that matters.
Maybe a really poor attorney will not be able to show that, but we have probably hundreds of developers that have been cheated. Note that they stated many times that they will pay every dollar, even here on this forum, and in direct email communications. I think the developers that haven't been paid should get together and we should make a single case. - 09-27-2012, 11:00 PM #143
A crime is a crime, no matter what attorney handles it. At least it is so in countries with the working legal system. I spent money on lawsuit, on attorneys, now I have a court settlement on which MobiHand defaulted, and now as they are bankrupt, my court settlement is just a useless paper. Why do you think your attorney will be better? especially when they already filed for bankruptcy. So far you lost only 5K, this is small, you will lose much more on attorneys and chances are very poor.
MobiHand execs have been lying for months, nobody cares. Now they work for other companies, one of them even founded a new company. They are invited by foxnews to give interviews. Nobody cares that they took developers' money. Even crackberry did not post a news article when all this scam started.
Lesson learned. Criminals cannot be punished and big attorney's fees will not be compensated, debts will not be collected.
Anyway, the only good thing is that you do not need to use an american company to sell apps via internet. Use the dutch avangate.com, the german pdassi.de or shareit.com or even israeli plimus.com At least legal costs are much lower in those countries. Even PayPal in many countries is controlled by non-US jurisdiction. E.g., I am under Singapore law with PayPal.Last edited by adeveloper; 09-27-2012 at 11:02 PM. Oh, sad to hear that the famous American legal system shown in so many many movies does not work.At least it is so in countries with the working legal system
Of course, there is no use suing the company. It is people behind the company that stole money.now as they are bankrupt, my court settlement is just a useless paper. Why do you think your attorney will be better? especially when they already filed for bankruptcy
If we have 300+ people whose money were stolen by the same criminals, it's obvious that they should not act separately. Most of those owed <$300 will say "don't care", and others owed <$1000 will say "I can't afford an attorney". But all of us are in the same situation, under the same agreement, and we need a single resolution. Read the "Advantages" section inbig attorney's fees will not be compensated

I wish I could, but being away from the US and not a native speaker makes things difficult. I am doing my best writing in this forum, but none of my emails have been answered (so far), and these legal/law terms are all new for me... I hope some good soul closer to the US in terms of location and language will find this thread and be able to help.If you could find an attorney...
Also sometimes I wonder if all these ~300 developers who are owed money ("we") should not get organized somehow so that we have a private page with our emails or a forum, and we can act faster and more efficiently. I'm afraid only a few of us read this thread and others may be unaware (I found this thread on google, but I never sold for blackberry in MobiHand, only for other platforms). And 300 emails sent to some organization regarding the same request/issue may mean more than a single email.
