Default Will I get a New Curve?

After updating the OS on the curve I have, there are several problems I can't seem to fix. Battery life shortened, Clock on phone doesn't always change until the phone is "activated," and it seems a little laggy sometimes. My 1 year warranty isn't up yet, so my question is what are the chances I'll get a new phone from them if they can't fix my phone?

Roll back to 4.5.0.81 if you haven't already. If you're already on .81, then call T-Mobile up for a replacement. If the Curve is not on 4.5.0.81, you will be slapped with a $100 out of warranty fee.

if your sending you old one for a new one via your insurance it will not be new its a refurb.

Yeah, I already rolled it back to the 4.5.0.81 that I downloaded from the T-mobile website. So I can just call them and tell them what happened and they'll send me a replacement (hopefully new) and I have to send them the one I have right? I'm sure they'll probably try to troubleshoot some stuff....but I've already done all that.

Insurance meaning warranty or the one you can buy? I didn't buy insurance on the phone because it came with a 1 year warranty for buying it brand new.

So I went to the T-mobile store today and the rep tells me I have to call Blackberry because supposedly I'm the only one who has problems with the "new" OS update. Guess I'll have to call and if they tell me to go to the T-mobile store again, I'm going to give the rep a piece of my mind.

Insurance replacements are not always refurbished.

As far as the OP, take it to the store and they should be able to help you if it is something warranty will cover.

Let me set things straight so everyone isn't confused on phone conditions upon claiming different things through T-Mobile. If you are claiming a warranty exchange through the one year manufacturer warranty, they will send you a referb within 5-7 business days (standard UPS shipping). This warranty covers defects in the phone. If you did something careless that broke the phone and/or it has physical damage, they will charge you 100 dollars upon receiving the device and inspecting it. If you are claiming a phone through Asurion because you have the PHP Insurance or PHP Bundle (4.78 or 5.99 a month) on your account, you have to pay a 130 dollar deductible and they will overnight you a brand new (not refurb) phone. These two packages cover everything you can do damage wise, including water damage. These two also cover lost or stolen. Keep in mind you need to file a police report to claim a phone if it has been "stolen".
