Default Unlimited Intl Email - Fraudulent misrepresentation?

I just recieved over $3000 in "internet access" charges while roaming in Spain with my BB 9700. Yet 7 other countries worldwide were billed as "RIM Blackberry". I have the Blackberry Unlimited International Email plan which states the following:

My phone is used for extensive email, many with PDF attachments, and BBM. I dont use social networking apps and only have Google Maps installed, but GPS is disabled. I find it odd that every month only the Spanish mobile carriers lodge billing as "Internet Access" that is sandwiched between "RIM Blackberry", which often times is a higher MB number. Every other country I travel to each month is billed as "RIM Blackberry" and the phone is used identically in each country.

TMO refuses to credit these charges despite pointing out that their website claims the Blackberry Unlimited International Email plan includes "a better web browsing experience", "Google Mobile Search", and "My Downloads", among other features. The fine print mentions nothing about anything else.

Has anyone else noticed this gross misrepresentation and fraudulent billing practice (that might have correlation to the class action lawsuit that was recently filed), and if so, what steps can be taken to resolve this?

the onlything i know about this is we offer a 20$ a month unlimited BB data plan for internaiton use it ONLY allows you to use email and BBM anything other thatn those two things will incur a 15$ per mb charge

i pulled up the policy on my computer hope this helps

Description
BBINTL add-on feature prevents customers from incurring data roaming charges for certain BlackBerry services, such as e-mail (BES and BIS), PIN to PIN messages, and BlackBerry Messenger.
Important: Customers can still incur international data roaming charges for services such as MMS, Visual Voicemail, and Web browsing (including web e-mail access through sites like Sign In, etc.)
Customers must be on a BlackBerry data plan or have a BlackBerry SOC added to their rate plan to add this feature.
Accounts with this SOC require a BlackBerry device.

Restrictions
Does NOT include Web browsing (this includes e-mail access through sites like Sign In, etc.)
Does not cover voice calls.
Does not provide international roaming permissions for data and voice.
Not available for:


SmartAccess
Flex Pay
Employee accounts

Bucket

So would that include even the pictures from emails where the email would be HTML and accessing the images from www pages? Probably not huh?

i think it does but im pritty sure downlaondg a PDF wouldnt be included it depends on how the file is attached like if you open the email and it has a embeded pic or somthing like that no charge but if its click here to download the pic or PDF charge

So essentially your internal information on the BLACKBERRY UNLIMITED INTERNATIONAL EMAIL plan CONTRADICTS what is posted on the customer website!

The TMO website, which I posted in the original post, clearly implies that some sort of web browsing in included!

Nowhere on this product page does it list restrictions of what is NOT included in the plan such as HTML, PDF downloads, imbedded pics, etc...

Is anyone else not seeing how clearly misleading this is?

TMO needs to refund these charges immediately! If not, what legal recourse do we have?

I'm sorry you were misled by what was on the site. Since you were genuinely misinformed by a poorly written site and not trying to "get out" of paying for data that you knew you'd be charged for, I think T-Mobile should reimburse you AND fix their site wording.

Let me know how this goes for you. After never having been charged a dime for international data since 2007, I was recently told that my time in the UK last week is going to end up costing me $1500 in data roaming charges. I would have dropped T-Mobile immediately, but I'm waiting for my billing cycle to complete so I can try to fight them on this.

Web2Go is the WAP browser. not the Blackberry Default browser.

hmm im not sure this page is for the BB international Data plan i think it just explains the BB data and that you can use it internationally

I see where the OP got confused.

There is a small description for the Unlimited International Email plan and then underneath, there are a bunch of descriptions about web usage on the Blackberry. Really, they have nothing to do with the email plan and are not included, but they are described right underneath it so I can understand how the OP would think that they were included.

That being said, I think he needs to call T-Mobile and get a credit and they really need to re-write that page. Simple misunderstanding and I don't think the OP should be punished. I can really see how one could misread that. Lesson learned, right?
