A. What are the stipulations....

3. If you swap BB's with a friend will they honor the warranty if it's just come out within the last year...even if you dont know when they bought it?.....what about the battery swaps....are they cost free...do you return the old battery and will they honor if your not the original purchaser?

1. Tmobile can provide an unlock for any tmobile phone except for the sidekicks.
A. Not sure what you meant by stipulations but you will have to be a tmobile customer for 90 days before they provide you an unlock code for valid reason. ie: if you're traveling over seas

2. If you have your own blackberry/smartphone then they won't require you have to a data plan. I believe its 24.99 a month for blackberry bis service. Check tmobile's website for more accurate rate.

3. Everyphone comes with a 1 year warranty. You don't have to tell them that you received it from a friend. Just ask them if the phone still has warranty on it. 1 year manufacturer's warranty includes the phone and battery. If tmobile technical rep goes through troubleshooting and its the battery and your phone is still under warranty, they will ship you a new one free of charge. You might have to pay for shipping.

As far as the unlock code, you may not need to give them any reason. I used the online chat support to talk to customer service about getting one for my Pearl because I was trading it with someone on AT&T for a Flip. They did not once ask why I needed the code and put in my request right away. A little over 24 hours later I had an email with my unlock code provided.

I ALWAYS get my phones immediately unlocked. You simply call customer service and ask them to process an unlock order. Within 48 hours you should get an email with the code. Now mind you, I've been a customer for awhile so there aren't any 90 day provisions that apply to me.

With the warranty....if the phone was purchased under a different account itll come back as "warranty not verified" in the warranty tool....once it comes back with this result 99.9% of the time t mobile will not send out another device to you and will tell you to contact the manufacturer. but they will be able to see if the phone has been used on a previous account and how long it was used on that account.
