Default Cancelling contract........

I've been w/TMO for about seven years. In Oct, I signed a new two year contract upon the full price purchase of the GX2. I am waiting for my third device to arrive as the previous two were defective. If the third is a dog as well, I think I want out & away from TMO. I've tried to research reasons for cancelling a contract, but have found mixed results.

Has anyone successfully cancelled? The CS rep said they would 'consider' a replacement device is the third GX2 device was defective. But, if that happens I'll want to move on. Also, the said I have 4G at my home location (on map too), but after speaking to CS, they said my location 'somehow' was not covered. It seems the corner location is oddly not reachable by closed cell tower/antenna.

Should I request a copy of my contract? BTW, the service from TMO absolutely sucks in relation to service several years ago. They keep saying they will do something and it never gets done so I have to call & call & call (i.e. account credits, ship replacement phone, retuen follow up sevice calls, etc).

I know I just answered you in the Android forum, but have you tried using their customer service chat feature? I find I get WAAAAY better help from them using that than when I call. Most likely they'll offer you another comparable device and that's it. If you don't accept that they'll make you pay the $200 termination fee, I'm afraid.

As far as you not getting service at home, though, that might just be something you can pursue because it could be seen as a breach of contract on their part.

only edge in my house. coverage map says 4g available. their response to this was to "set your phone to gsm only." that is not an acceptable response when you pay for a 4g device that is supposed to cover 4g at your residence (and you work at home).

No carrier guarantees any level of service "in your house".

Do you have something in writing that guarantees you 4G service?

Saying "The carrier sold me on 4G at my home per their website." isn't going to be sufficient proof for you to convince them that you are not getting something that you were "promised">

Can you get wifi in your house? I hardly every use my networks towers. I just use wifi the whole time I am home. I mean if you work from there, you would think you would have something like that setup.

If not, you wont get a breach of contract. Tmobile is spotty at best signal wise. I have 4G at work in certain areas and I move 100 yards and I am on EDGE. I guess I should call and complain that is blasphemy and if they dont correct it, then it is a breach of contract and I want out!

Take the good with the bad. How tmobile is for the most part. I usually get great service, so I dont complain to much.

an update in this issue. I have had my third GS2 for about six weeks and the phone has basically started to perform as the previous two. after about six weeks, there is a huge lag in most applications, and its worst on email (as were the other two). If I touch the email icon, I get to the next screen pretty quick (only two accts; one pop and one exchange). But, after that, any email acct I choose I sit and wait for at least five seconds for the screen to come up, and then once the screen is up, at least 10 seconds for the mail acct to open before it refreshes.

since I have had this behavior on all three phones (they work for about six weeks then slow tremendously), I took to the TMO store and had their reps test it and log the results into my acct. All have said they don't know what the issue is, but there is definitely a problem.

I keep my mail cache under 20mb, constantly clear RAM, but no performance help.

Anyone have any ideas?

Get a sensation...seriously. The only thing the s2 has on it is the amoled screen... Ask for a replacement.

There was a recent e-mail from T-mobile that came out: "Important Notice about Domestic Data Use While Off the T-Mobile Network". Would that be an out for you in your case? I asked this question in a recent posting.

I've yet to try to use this as an out from my contract and avoid ETF altogether, for 4-lines of service.

I have been a loyal TMO customer since 2004, and as of late, I made the mistake of resigning with them in Feb. Mistake for various reasons, from mail in rebate cards not being approved for the reps fault, to crap signal at home, to even not honoring the previous EM+ plan I had, same guy who signed me up for it, said that "I can't sell you a phone anymore". That's when I should have said "bye!" but for other reasons, I chose to stay.

But hey, most things got resolved in the end, like the MIRs but now, its been months I get NO 4G data speeds. Granted, I made conscious choices, so it is my fault on some ends, I don't argue that, but when I pay for something, I expect it to work as they say it should, or boasts that it does. When it does not, then they should let me out of contract without ETFs and not give me BS excuses like go on WiFi or stay on EDGE or "I'm sorry". So TMO lately has gone the drain.

Its not the device as some moron stated btw, its TMO. Just because YOU get 4G everywhere, it does not mean EVERYONE has to also. I get full bars, both EDGE and 4G, and EDGE is faster than 4G and this was the same for both android phones and the 9900s me and my bro have. So pls...

Yesterday I called in, first CSrep told me that my area has no 4G coverage, which is absolutely BS, she then makes me speak to some other person, who says I am surrounded by 4G towers. ??????? ok... Since of course the answer is simple, and they can't admit to it, she says she will make me speak to Tech Support... And that's when the call dropped, on my land line (She said she had to call me back on another number so I gave her my home one). Never got a call back.

Today I go to the store, and again, its another "I'm sorry, there nothing I can do". I don't argue because I know they are useless for most things... but after all this rant, I can't believe there is nothing I can do to break the contract without ETFs.... What if I am moving out of the country? If I don't get service, why should I pay for something I am not getting? Its like I sell you a Toyota and tell you it goes like a Ferrari, if it doesn't, would you pay for it? No... and your answer should not be, "its still a car".

I know its an old thread, but I reused it without opening another one since I also want to switch without having to pay ETFs for the reasons mentioned above.
