Upgrading without a Data Plan?
First of all, I LIKE using a pay-per use data plan, and I have a blackberry (8700c) without a data plan, that was before the rule came out that you had to have one with a smartphone. So, if At&t knows that my phone is a blackberry, will it know the type of blackberry it is that I would have upgraded to? (Meaning putting my sim card into an unlocked phone). Or, if they know that the phone is different, will they add a data plan? Would having a blackberry, without a data plan before that announcement came out that you had to have one, keep At&t from automatically adding a data plan.

they will know that it is an updated blackberry and slap you with a data plan

If you stop using a smartphone, or use another smartphone, you lose your exemption. The only way to keep it with such a change is with a warranty or insurance replacement.

AT&T adds data plan automatically but you can contact them and ask to avoid services.

They recognize what ever phone is being used on their network. If they force the plan, call them and tell them to take it off. My mother in law used a BB8310 without a data plan and SMS and voice worked just fine.
