Question on the 30 day return policy

I am going to have to take my Torch to the ATT store because the earpiece is shot. But I'm not settled on keeping the Torch. I might want to switch to the iPhone, depending on how the Torch feels after a couple weeks.

So, if I were to get a refubished Torch as a replacement, would that count as a return? Or would it be just using my warranty so that I could return the Torch laterif I don't like it?
