Default Upgrade question

I was eligible for an upgrade last month, so I ordered an Evo 4G online a week ago. An hour later I changed my mind and decided to stick with Blackberry so I ordered a BB Style - and the order went through. I emailed customer service to ask them to cancel the first order, and was told that there was only one order in the system for my account - the Blackberry.

Five days later I'm notified that my Evo is ready to be shipped; apparently a software malfunction screwed up some orders the prior weekend. I called Sprint to ask them to stop shipment - they said I had to call UPS. I called UPS; they said Sprint had to call them. I called Sprint AGAIN and they said they can't do that; I have to refuse shipment and wait until they get it back in the warehouse to credit my card.

It just occurred to me that I may be able to accept the shipment and sell the EVO. Does anyone know if phones sent from Sprint have an ESN that is attached to accounts? In other words, would I be able to sell this thing, before even activating it??

It sort of seems like they messed up and gave me an upgrade price twice, but that wouldn't stop me from doing whatever I want with that second phone. Am I thinking correctly here?

If you think they're not gonna charge you full price for one of them, I assure you, that's not going to happen. If you don't return the device you don't want, they will tack that onto your bill.

Every Sprint device has an MEID #, and this number can be blocked if they want to, for non-payment, fraud, etc. Just return the device you don't want and all will work out fine.

I know it will 'work out fine.' I'm not worried about that. I was just wondering if their error could be conceded by them in allowing me to get the phone at that price, especially if whoever activates it agrees to new contract terms.

And by the way I have to drive down from the top of a freakin' mountain, and then 30 miles up a windy highway, to take care of this. Bleh.

hmm If you charged device to account I believe you must activate on your account before device can be sold to 2nd party.

a couple Choices ,

Activate new device for a day ESN swap to old device then sell.
Or
Skip that nonsence call up Retentions have them send you return kit Track package to warehouse.
Once they get it contact retentions have them credit account.
