does the new purchase out right policy at tmobile mean i can jus walk into a tmobile pay the $579 and walk out with something shiny ? or do i need to have a data plan ?

You can walk out with the device, no service purchase required. However, if you're looking for an unlock code, they have some 40 day service requirement, if you're a new customer. I'll have to look it up, but they don't provide the unlock code too easily.
