I was just browsing cb and noticed a gap inbetween the top left screen and my lock button. But there isn't a gap between my top right screen and mute button. I also noticed my mute button doesn't even press down. I knew this but didn't care since that button doesn't do anything. I was just curious if amyone elses tour is like this.

yeah mine is def crooked, and dust gets in the gap and its pretty annoying.
my mute works, but you really have to press compared to the lock key.
lets just face it, the tours were poorly made compared to the bold and curve 8900 series. it was made just to hold over cdma customers that wanted a decent berry that was considerably nicer than the cheap curve models.
I had the issue with the lock button coming un-glued. Took it in, and got a warranty replacement on it. This refurb that I'm on now is sooo much better built.
