Default ROGERS vs ME

Ok fellow cell phone users, i need your help big time. this is gonna be a long one so i hope your ready..
i had gotten my new blackberry bold 9780 around May from an upgrade that i was due so i signed a new 3 year deal and got my first ever bb. everything was fine till i noticed that the faceplate(the black plastic surrounding the phone) was loose and started making clicking sounds. it was a minor thing and i had given my phone to rogers to repair, i told them they could glue it or replace it whichever since i didnt really care. i gave them my phone on august 15 and today is october 21... they had kept telling me oh the phones coming back in 2 weeks just wait. so i had waited and waited, after 1 month and a half they then told me ups lost it, so i told them to refund me, which is normal right.. i mean i did pay the 100$ or wtv for the bb at the time and signed a new 3 year deal. so now they keep telling me oh we cant do anything till ups pays us, its been a month that they have been saying this and are refusing to give me any sort of phone till ups pays them for the lost phone. at this point it looks like they are never giving me a phone at all.... the point is, i am not dealing with ups here, it is rogers dealing with ups, it is not my fault the mailing service that rogers decided to go with lost the phone. so what can i do? we thought about taking it to small claims court but thats going to take a really long time. so my dad and i are thinking about cancelling our contracts because we have been completely disrespected and not only that they stole my phone which i had paid for, i had only signed a new 3 year deal so i could have a blackberry.... my dad has been with rogers for over 22 years which is more years that i have even been alive, he was with the company that had bought rogers previously. now what can i do to get my phone back or how can i cancel my new 3 year contract without paying the cancellation fee? im thinking about not even paying for it even if i cancel because they had taken my phone

ive called so many times, atleast 10 hours added up and thats not including all the time i spent going to the actual store

Unfortunately I have come to the opinion as of late that Rogers really does deserve the nickname Robbers.

I have been dealing with no 3G and spotty 2G service in my city for 9 months. I have probably missed upwards of 100 phone calls because they just don't come to the phone even though they are ringing on the callers end. Some for OT at work so I have also lost the money from those shifts as well. I also don't get VMs or texts/bbms for minutes to hours after they are sent so people think I am just ignoring their calls. Rogers knows this, and have acknowledged they know it and they just keep saying it will be fixed "next month", then the next month comes and they say it will be the next month "for sure". Next month comes and surprise, they say it will be the next month. They don't care about the customer. I used to be a big fan of Rogers until this. They used to resolve my issues satisfactorily. Now it seems like they could care less.

Pretty soon, I will be cancelling my internet, cable and wireless with Robbers and taking my business elsewhere. Once they have your name on the dotted line they could care less. Read the contract. Buried deep in the fine print it literally says they make no claim or warranty that your hardware or cellular service will function properly. What a joke.

Finally someone who understand where im coming from, if i were you i would have long cancelled my phone plan seeing as how you cannot even use your phone properly... i intend to terminate my contract A.S.A.P but i refuse to pay to cancel my contract because my 3 years isnt up yet, idk what i can do to avoid these charges.

and for them to lose my phone and refusing to give me anything back(stealing) is just unbelievable..they have to be breaking some kind of law

I am in the same predicament as you. This all started just one month after signing on for a new 3yr contract. I had been happy with them up until that point so I figured why not? Now they want me to pay the full cancellation fee to get out. That's how I found out about that clause. I was told they don't have to let me out of my contract because there's nothing in the contract that guarantees uninterrupted service, even if the interruption is 9 months long. Its total BS. I feel your pain. I have spent countless hours with rogers CSRs, supervisors and even the office of the president over this issue. Many treated me like I am garbage. I was given a direct number to the office of the president and never even received phone calls back when I left messages. Its disgusting, and a prime example of big corporation greed. Screw the little guy, because there's always another willing to take their place, as long as their pockets keep getting filled.

is this it for you though? is there anything else you can do? are you staying with them?
because me and my dad are now looking around for other rates for other companies. i dont know what we can do about not paying my cancellation fee though or how i could get back the money i payed for my blackberry

I am going to keep trying to get out. I know a couple people who successfully convinced rogers to waive cancellation fees. Luck of the draw with who you can get on the phone I guess.

The only thing I did find was about something called the "material adverse clause". Apparently if Rogers makes changes to your contract you have 30 days to cancel without termination fees. So I guess if you can't convince them to let you out with no charges keep a close eye on the conditions etc on your bill for changes and use this clause to get out.

Just an idea, I haven't fully researched its viability yet
