Default Hardware Upgrade Question

So my 3 year contract is up in a few weeks, and am thus eligible for the HUP but I am wondering:

- Do I have to give in my current phone when upgrading? I'm already using a Torch that I bought in September and was hoping to "upgrade" to a new Torch and just sell it (keep the money for the 9900 maybe...). I called in to get prices for the upgrade and the rep seemed to think I was still using the 9700 so maybe it's possible to just bring in my SIM card and walk out with a new Torch?

Unless the rules have changed (again) a purchased outright phone does not affect your HUP. That's based on the length of time of your contract and the phone you originally got with that Plan.
If the 9700 is the phone you originally got with the Plan, that's the one 'on record' attached to your account.

If you wish to re-up your commitment on a new contract, Rogers will be offering you an 'upgrade' based on this, not the Torch. If you choose to stick with the Torch you got in September, you don't necessarily need to get a long-term contract - and you won't be using this contract to defer the real cost of a HUP phone.

Not sure however if current SIM will work with newest phone, though. No practical experience with current crop of BBs.

No you don't have to turn in you current device when you do a HUP. You just have to commit to Rogers again for another 3 years to get the best price on your new device.

You would even be able to still keep your 9700 as well - your current phone(s) has nothing to do with your upgrade. Once you own it - it's yours. Even if you want to break mid-contract Rogers doesn't make you return the phone they make you buy out the term of your contract to a max of $500 (data & phone plans).
