    Sounds like no one is even too clear if "anything" is showing.
    Ding, ding, ding, ding, ding!!!

    Like most of life, it's not a matter of black or white - but a shade of gray.

    Is it a shadow (as the school district maintains) or is it something more?

    Impossible for us to tell, since we can't judge for ourselves.

    But, based on the interview (even mom is less than definitive - she's more in the group of "hey, you may think it's just a shadow, but to be safe - take it out") - I'd say it's not very clear what (if anything) can be seen.

    So, I'm not inclined to assess any party "fault" at this time. Nor - without something more definitive - would I cave into the mom's "demand" for the yearbook to be pulled.

    I would note a "psychological phenomena" can be at play here: you see what you *believe* (or are inclined to believe) you see.

    The girl KNOWS she didn't wear panties, so she believes her "bizness" is on display.

    Other people looking at the photo WITHOUT that "knowledge" (year book staff, etc.), see just a "shadow" with nothing explicit.

    Now, if someone SUGGESTS it's her "bizness," you're more inclined to SEE her "bizness" in the photo . . . and, if I remember correctly, that's how high school works. Rumor and innuendo trump objective fact.

    Hmm, I went back and watched the news video.
    Both mother and doughter are wearing short shorts. the mother is sitting cross legged and the daughter is sitting in an inappropriate position for national television/news.

    Smack! da Mamma for not teaching her child proper posture and etiquette.
    Mama sounds like one of those who will blame the schools for not raising her child for her.

    Now note how CNN shot the video from farther back to show how they were sitting. Most interviews are from the waist up when shooting 2 people.
    I say CNN is going for the sensationalism shot to keep viewers upset.

    That girl showed a remarkable lack of common sense, which sadly is a reflection of the times we live in.

    Personally I blame Paris Hilton, Britney Spears et al. Their antics made it all seem perfectly acceptable.

    Yeah...but you assume she's got enough sense to be humiliated. Folks do a lot of stuff, that would be humiliating/embarrassing to you or I, but they have no shame...which is why they do it, in the first place. Now, she may grow some shame, down the road. Maybe. That's the trouble with children/young people...they're often plentiful in knowledge, but low on wisdom.

    I never will forget something I read here, in the infamous "sexting" thread. I thought to myself, "I would never tell that, if for a moment I lost my mind and actually did something like that". The other person didn't seem to have a bit of shame about it. Blew my mind...and it takes a lot to do that.

    I personally think its everyones fault. I made quite a few post in this thread but I have a sneaky idea a lot of them got deleted. I'm in no way saying the actions are "okay" nor support the idea of a minor doing this type of action.

    It can be done all they would have to do is reprint the year book with that picture edited out. And yes it would hold up in court since it contains child pornography. The mother just isn't fighting it the correct way IME. Granted it'd be expensive, but it keeps everyone from being a felon.
