Default 4G?

if I understand it right, being able to get 4G is a hardware issue and has nothing to do with software. Is this right?

Therefore if I move up to a 9850, I would be stuck at 3G speeds for the next two years. Is this correct?

Depends what you are calling 4G, if you mean LTE, no BB currently has the hardware to do that. But 4G is a over used marketing term than can be applied to HSPA+ which BB do support. So in reality HSPA+ is faster than the original 3G spec but not as fast as true 4G/LTE, so it's more like 3.5G. Which in reality is more than fast enough for most of us.
