    Remove your SIM... Burn it. Your device too. (Except for the battery, be sure to properly dispose of that in an environmentally responsible fashion.) Then bury the remains somewhere in the desert... Abscond the area promptly and go dark for a few days... It's the only way to truly be certain...

    I suggest to register on this site and to concretely describe what you noticed "acting odd".

    Not every strange behavior is a "virus" or "spyware"...

    You said your BlackBerry is new... really new, took out of a sealed box? Or was the seal broken and the device has been tried previously?
