talking on the phone is OK...with some sort of a headset and all phones should support voice dialing! I have become spoiled with mybluetooth and the voice dialing feature of the Curve. I will never go back to dialing with my hands....

As for me, I think it would be appropriate to see more people using head sets, I do believe here in California there is a law that will go into effect next year in JUNE 2008 that one will have to use a head set while driving due to some congress woman getting into a car accident and then trying to pass that law. Again though studies have shown accidents have more frequently been committed while those driving and talking on their mobiles.

Yes they should but not limited to Blackberrys it should be for all phones. I admit I do text/email in the car sometimes, but I try not to in real traffic.. my work route take sme through several lights so in those 30 second bursts I can read mail and send texts etc

No, I personally don't think so. I use my BB quite often, but responsibly. I feel as though "Big Brother" has restricted us enough already as it is.

Maybe should make it neccessary to use hand free kits while talking on the phone...but for the most part phone talking, cigarette smoking, beverage drinking (non-alcoholic) should all be allowed. If something happens because of it...then the person should be held responsible not the item in question...text messaging and emailing on blackberry (or any other phone) should not be done while driving...can't look at keyboard or screen while trying to drive. however holding a phone to your ear is somewhat different...
