I am almost sure this works as of July 1 2009 they changed there voice and email rates. So if they change contract agreement I think you have 30 days to get out of your contract. Better hurry if you want out.....

I'm sorry to be a noob when it comes to contractual stuff but what does that even mean?

IIRC there is a clause or Law that allows US customers to terminate their contract without early cancelation fees IF the Provider changes the terms of the contract.

Thank you. So is this a legit change or is it just a rumor? And if it does happen, how much would it really affect the bill?

Ok I'll check it out. I very look at my bill thoroughly unless there is a significant change. I guess I should start paying more attention to things.

Hmmmmm...interesting. I have 3 lines and I am looking at canceling one of them. Im not so sure that this would be a legit reason to let us out of a contract though.

there's also a part in there that says Verizon reserves the right to change those charges at any time, provided they give you notice. Verizon typically gives 3 months notice.

Oh, and if you do feel that it's necessary to run away from a few cents per month, you were probably already going to leave anyway. And what's more, if you escalate - expect the rep to just credit that amount for the rest of your contract. They won't just go "ok, I'll cancel your service".

You're absolute right about that. They never just "let you go." Before that they will make a few offers to you, even after you cancel they will try to entice you back.

I actually just called and talked with a vzw rep. about it. And she stated that it states in our contract that these rates due fluctuate. And that they sent out notices(I never recieved one). Good luck on getting out of your contract.

I don't have VZ but I'm curious, wouldn't they have something in their contract that says they can change their rates but you can't opt out of the contract if they were to do so?

The changes in the contract terms are highly unlikely to allow you to rescind (get out of) your contract.

The change in terms is relatively minor, to the point where Verizon will say it is immaterial. This means, that you are stuck. If the significantly change the access price per month, decrease your minutes for the same price or some other major aspect of the contract, then you might have a valid chance.

The fact that the change is so incredibly small will not be grounds to void your contract.

Even if they did so without notice it still wouldn't be grounds to get out of the contract, but b/c they did give notice I see zero chance that Verizon lets consumers out their contract.

Well...let's see...you could move to another carrier without paying the ETF. You could then sell your device on eBay or craigslist which might help defray the cost of a new phone.

you can use it as leverage to get free/discounted equipment....sprint changed something like this earlier in the year and after a bunch of run around my lady was able to leave ETF free and came over to VZW

Exactly. Leave Verizon? Might as well just throw my phone in the Potomac and live without any service at all.

This is absolutely hilarious. A $0.07 increase in other industry in your life (gas, electric, and cable) would be thrown by the wayside but as soon as a cell company does it it is a consumer rights nightmare.

Soooo you want to get out of your contract over $.07????

It just seems silly to me.
I mean if it was a more signifigant change like a manditory no grandfathering pp change increase of like $15-$30 or more? I could see that being an issue. But at the same time they warn you when things like that change. Like when they went from min usage to mb usage for internet. They warned everyone well in advance. They probobly did inform you on the bill too, but those are at the bottom of the bill and is rarely looked at. I know I have to remember to look on the last page to make sure I know whats going on.
Still $.07 is a moot point to complain about... you'd be laughed at while on a "silent" hold.

    Our Rights to Make Changes
Your service is subject to our business policies, practices and procedures, which we can change without notice. UNLESS OTHERWISE PROHIBITED BY LAW, WE CAN ALSO CHANGE PRICES AND ANY OTHER CONDITIONS IN THIS AGREEMENT AT ANY TIME BY SENDING YOU WRITTEN NOTICE PRIOR TO THE BILLING PERIOD IN WHICH THE CHANGES WOULD GO INTO EFFECT. IF YOU CHOOSE TO USE YOUR SERVICE AFTER THAT POINT, YOU'RE ACCEPTING THE CHANGES. IF THE CHANGES HAVE A MATERIAL ADVERSE EFFECT ON YOU, HOWEVER, YOU CAN END THE AFFECTED SERVICE, WITHOUT ANY EARLY TERMINATION FEE, JUST BY CALLING US WITHIN 60 DAYS AFTER WE SEND NOTICE OF THE CHANGE.

Now one would need to argue what is a true "material adverse effect".

I think your missing the point really. Its not the .07 cents that people want to leave over, its the fact that something like this allows you to get out of contract EFT free.

Now if you've been wanting to leave VZW for another carrier for whatever reason but didn't want to leave just yet due to the ETF this may allow you to get out early missing that charge.

It will not work - the admin fees, taxes & optional services (data/text/rbts/etc) are not part of your contract.

The ONLY way you can use this to get out of your contract is if your 450 minute plan increased from its current $39.99 - if it goes down, you don't have a prayer.

If your text charges triple & they suddenly want $5/mo for your RBTs, you're stuck.

There was some form of legal complaint against cell phone companies a few years ago for this very reason. The cell companies won.

You can't honestly think you're going to outsmart the carrier legal teams over seven cents, do you? Please don't tell me you're that arrogant with your conniving attempts.

And, by the way - materially adverse would mean they took down towers that served your area & no longer offer service - or they discontinued voicemail - something along those lines.

Give it up - this is something people have tried for years on all carriers. It doesn't work.
