Which means? I am not an ATT subscriber. I would really like this phone though.

not being an ATT subscriber is exactly why.

just get it off ebay or through another seller. carriers don't have a reason to let stock go to those who aren't their customers or becoming their customers. (yes i know we should be able to get them, but why waste stock on those that won't use their service?)

    you still haveplenty of options.

at the moment, I'm sure with some digging you may be able to find the torch at the $499 retail pricing at&t offers. Some places may be able to be talked down since retail pricing is always a significant markup from their cost on it.

    Can't online. From their site:

    No-Commitment Pricing

You may purchase a new AT&T phone without a contract at the no-commitment price. This non-discounted equipment purchase option does not require a two-year contract or other long-term service commitment. No-commitment equipment pricing is available to customers that are not on a prepaid or GoPhone® plan. You can purchase a phone at no-commitment prices at AT&T retail stores. For an AT&T retail store near you, visit our store locator.

Just buy the phone on contract then cancel the contract within 30 days and keep the phone. They will charge you the difference between what you paid and retail price.
Who cares which device is better? Isn't all that matters is that it's the best one for you?

I wonder how long until they allow for outright purchase. I am an ATT customer but not eligible for an upgrade yet and wanted to buy outright. Waited 45 minutes in the ATT store and was told that I could not buy it. The saleman walked to the back to get the phone and I was all pumped but then came back empty handed. He was told due to supply they could not sell them.. Bummer.
