    These types of app pop up every once in a while. I'll say the same thing I always say about them: be aware of the possible legal ramifications of tracking your employees via GPS.

    Well if its on company phones theres no legal problems. It is the company's property they can do what they want with it. Now if they have this installed (some how! I know id resist to it) on personal phones. Then yes legal actions may be taken about privacy. Unless (like i said why would they) give consent to the use of this product on a personal device then they have consent.

    Nice app i know alot of companies off hand locally that use this type of product on laptops, cellphones and vehicles. Used for the purpose of saving money and making sure people do what they are supposed to do.

    Not entirely true, there can be some legal ramifications, at least in some states. If the employer allows for personal use of the cell phone, they'll run into some serious problems. If an employer provides a phone and allows personal use of it, or if they pay for part of the bill, that user has a reasonable expectation of privacy while making personal calls.

    If the employer has a policy that prohibits any and all personal use of the device, then its a different story. In this case, the employee has no expectation of privacy.

    On another note, you have to be careful with emails and text messages. In all states, electronic communication cannot be recorded without the express knowledge of at least one party to the exchange. Some states require that all parties know and consent to the recording.

    As far as GPS tracking goes, there's another issue. In order for GPS tracking of a device to be legal, the use of that device must be restricted. Let's look at a car. If you provide a company car. And that employee is to use that car only to drive to and from a given work-site and for other enumerated work-related activities, the tracking is fine. If, however, that employee is allowed to use the car for personal puposes and/or makes a monetary contribution for the use of the car, the tracking is a no-go. It all comes back to the user's expectation of privacy. If that phone is to be used only for work-related purposes and only at work-related sites, you can track it no problem.

    Notwithstanding, we have to keep in mind that the Constitution only protects us from the government, not private employers. As such, you would truly have an uphill battle. In order to have any civil remedy, you would have to show that this tracking violated your privacy AND that said violation caused injury to you (I don't mean physical injury).

    Good idea for an app, just not so sure many companies are willing to deal with the civil liability issues.

    Hey bigsteve,

    I agree that giving all those variables such as partial payment or a personal company issued phone would be illegal. What i meant is if the device is for sole company use. A device that can simply be reissued to another employee not one for any personal use where the company provides it and pays it in full. As far as GPS i wouldnt even use a phones GPS to track. This is a big thing in the field i study and work in and for the most part its for use on all official company vehicles and devices of high value both money and information wise.

    But your right all the planets would have to be aligned perfectly for a full system like this to operate 100% legally which in the real world most of the time it doesnt happen.

    I just think that it would have very limited legal use.
