Default Black Dot when using Camera

So, I recently bought a Curve 9360 for AT&T from Amazon Wireless, and it's been brilliant so far, a big step up from previous Curve devices.

However when I was using the camera, I noticed something a bit strange, in the form of a black dot in the photo. From experience, I assumed this was just a bit of dust, and cleaned the lens, but it remained there even after cleaning.

I'm wondering if anyone else has had this experience with their devices, Curve or any other models recently? I've done a usual search and found random threads about this, but no one ever says what the root cause is.

As of now, I'm assuming it's an issue with the sensor, and that I'm going to need to request a replacement from Amazon, but I'd like to see if anyone else has any thoughts about it. I've attached a photo below, zoomed in to a white sheet of paper where it becomes quite obvious.

i think it's a problem with the camera itself.
my dad's phone had that problem, but with a line running across the top of the screen...
